Re-Mortgages or Transfers of Equity

Once you have a remortgage offer ‘in principle’ you will need to then appoint a solicitor to handle the remortgage conveyancing on your behalf. Mortgage lenders will insist that you instruct a solicitor. Whether you wish to get a better rate that your existing mortgage or release equity from a property – perhaps for a related property purchase – Manisha will ensure that it happens as efficiently as possible, from the redemption of the existing mortgage to the completion of a new one.

Transfer of equity occurs when the owner of a property wants to add a person to, or remove a person from the register of a property, or when the amount of equity someone has in a property is increased or decreased. This process can be required when a property is being passed to a relative, if a couple has split up, if a single person wishes to add a partner to their title deed, or even pursuant to court orders. This can be a complex area depending on your specific circumstances. You may need to pay Stamp Duty Land Tax on the share of property you acquire or on the outstanding mortgage. Manisha has extensive experience in processing transfers of equity and matrimonial transfers.

Grant of leases, licences

If you own a commercial property and intend to grant a lease, tenancy or licence we strongly recommend that you to obtain advice before doing so. The law relating to leases and tenancies is extremely complex and once a tenant has moved into your property it may be difficult to rectify any mistakes.

Manisha has many years of experience in commercial property and can advise landlords, current tenants, assignees and guarantors on commercial property lease assignments and new leases.

Where a Licence to Assign is required either because you are giving a licence as a landlord or because you need one as a tenant or potential tenant, Manisha is able to assist. Various other documents/deeds maybe required tailored to the individual commercial matter and Manisha will be able to guide you through these requirements.
